Introduction

These Terms of Use define the conditions for using the portal of the Digital Library of the University of Salerno, Liberabit, curated and managed by the University Library Center (CBA). The portal provides access to its digital collections as well as to those of partners involved in the various projects hosted on the platform.

Licenses of Use

All content available on the platform is governed by current copyright legislation.

The digital objects available on the platform may be:

• owned by the University;
• owned by institutions or third parties who have granted the University the right to publish them;
• in the public domain.

For works it owns, the University has chosen to apply the most open licenses possible to digitized materials (in compliance with current copyright law) and does not apply additional rights to works already in the public domain. However, for certain collections owned by the University or by third parties who have authorized their publication on Liberabit, more restrictive licenses may apply.

For digital content protected by copyright and not freely accessible, the provisions of Italian copyright law apply (Law no. 633 of 22 April 1941, as amended and supplemented).

Metadata relating to digital content are released under the Creative Commons Public Domain CC0 1.0 license.

Each digital object published on Liberabit is associated with a license chosen from the Creative Commons licenses, which determines the terms of use in compliance with intellectual property rights.

Users intending to reuse digital content are always required to verify the terms of release and reuse of the digital images.

This is the most restrictive license: it allows users only to download and share the original works, provided that they are not modified or used for commercial purposes, and that attribution is given to the author.

For any other type of use of the images, explicit authorization must be requested from the owner of the digital content.

Users are required to review the terms of use and the licenses associated with the deposited objects.

Authorization for Reuse

Unless otherwise specified, users are free to:

Share: copy, transmit, publish, make available, reproduce, distribute, extract, reuse, display, and store the content of this portal in any form, format, and medium worldwide.

Adapt: modify, transform, translate, create adaptations, summaries, or extracts of the content of this portal, or create other derivative works based on its content.

Conditions:

Attribution: users must attribute the ownership of the rights to Liberabit and/or to the institution named in relation to the content, citing the portal and the owning institution, and must preserve the integrity of all attribution data.

Non-commercial: users may not share or adapt the portal or its content for commercial purposes.

Share alike: any adaptation of this portal or its content must be distributed under the same license terms or under terms compatible with these Terms of Use.

What Happens If the User Violates These Rules?

Violation of the terms of use may result in the user being denied further access to Liberabit content, without prejudice to the University’s right to take civil and/or criminal action to protect its interests and rights, including claims for damages.

Intellectual and/or Industrial Property Rights of the Works

If any content on the site is protected by rights and the legitimate rights holders were not contacted and/or identified due to error or unavailability, they are invited to notify the CBA at dircba@unisa.it in order to define any necessary authorizations.

The University reserves the right to remove and/or disable access, including preventively, to digital objects for which unlawful use is identified or a dispute arises regarding intellectual and/or industrial property rights.

Partners who authorize the uploading of digital objects they own grant the University usage rights within the limits and for the institutional purposes agreed.

Specifically, within such limits and purposes, partners grant the University a non-exclusive, royalty-free, unlimited-time and unlimited-territory right to use, in whole or in part, the archived digital objects an unlimited number of times, including, by way of example and not limitation, the right to publish, reproduce, distribute, transmit, archive, modify, or make changes required for technical reasons or long-term preservation requirements.

Limitation of Liability

Under no circumstances may the University be held liable for damages of any kind, whether direct or indirect, arising from access to the portal, use of interactive tools, inability or impossibility to access it, or use of the information contained therein.

The CBA assumes no responsibility for external websites accessible through links provided on the portal.

Privacy Policy

The University respects the privacy of its users and protects their personal data, and undertakes not to disclose personal data to third parties without explicit authorization from the legitimate data owners.

The University may be required to provide personal data in compliance with legal provisions, warrants, or court orders. In all other cases, personal data are processed in accordance with current Italian privacy regulations.

Registered users voluntarily provide certain personal data, enabling the University to offer personalized services. In order to expand and improve these services, non-sensitive personal data may be used for statistical analysis and research purposes to better understand users’ needs.

By using the University’s online services, users consent to the acquisition and use of their personal data by the system, where necessary and as described in these terms. The University may modify its privacy policies without prior notice.

Amendments to the Terms of Use

The University reserves the right to amend these Terms of Use at any time and without prior notice.

Any such changes will be communicated through the Liberabit website.
